West Virginia Pool Code Requirements

West Virginia regulates public and semi public pools, spas, and similar facilities as recreational water facilities under Title 64, Series 16. The rule applies to owners and operators of recreational water facilities, and the definition includes facilities operated by communities, apartment complexes, condominiums, clubs, camps, schools, institutions, parks, mobile home parks, hotels, and similar public facilities. It does not include a private residential swimming pool as defined in the rule.

West Virginia requires an operating permit to conduct, control, manage, maintain, or operate a recreational water facility. The operator must prominently display the operating permit at the facility. Construction or renovation also requires a construction permit, and the application must include plans and specifications such as water source and treatment details and specifications for filtration, chlorination, testing equipment, and other factors needed for a complete operating system.

West Virginia also requires qualified operator oversight. The rule defines a Qualified Water Facility Operator as an individual who has passed a recognized Certified Pool Operator certification course, such as those offered by the National Spa and Pool Institute, the YMCA, or an equivalent course approved by the Commissioner. A qualified water facility operator must be available for consultation at all times the facility is open for use.

For water quality and daily operation, West Virginia requires facilities to maintain water chemistry and clarity standards. The rule requires enough water clarity to allow the main drain or a 6 inch black disk on the bottom of the deepest part of the facility to be readily visible from the sidewall. It also requires approved testing equipment to be available at all times, written test records to be maintained for at least 1 year, and for pools other than bathing beaches, pH and free chlorine residual testing not less than twice daily. The water quality table in the rule shows a minimum free chlorine level of 1.0 ppm and a pH range of 7.2 to 7.8.

West Virginia also requires safety equipment and emergency planning. Recreational water facilities must have a shepherd’s crook and reach pole available for use, maintain equipment in good repair, keep a readily available fully stocked first aid kit, and maintain a written emergency action plan that includes life threatening emergencies, non life threatening emergencies, chemical spills, and environmental emergencies. In certain facilities, certified lifeguards are also required, while some hotel, motel, apartment, condominium, mobile home park, and similar facilities may have recommended rather than mandatory lifeguards depending on the conditions described in the rule.
